All Free Speech is Created Equal…

...but some is more equal than others.

Here’s a modest proposal: obviously, the effects of the Buckley v. Valeo, Citizens United and McCutcheon decisions can only be completely overturned with a Constitutional amendment. Either that, or a dramatically reconstituted Supreme Court (which most Americans now see, correctly, as just another political branch of government). In the meantime, I suggest we pass a law in state legislatures and Congress stating that lawmakers must recuse themselves from any vote on any piece of legislation that will directly benefit any person or organization which donated more than, say $500, to them in the last two election cycles. Whore yourself out to the oligarchs all you want, in other words, but you can’t do their bidding. This would necessarily require a strong and independent ethics commission to enforce, but even that is less difficult than amending the Constitution. You could require than each bill be accompanied by an Ethical Impact Statement that lists all donors who would directly benefit from its passage. It’s not a perfect solution, of course; for one thing, SCOTUS may well be on the verge of completely throwing out all disclosure requirements as a violation of the right to anonymous speech. For another, it wouldn’t effect governors or presidents. Still, it’s a start. Progressive states might even add scuh a provision to their constitutions, thus making it harder to water-down or throw out as the political winds shift. That’s my contribution to the debate.

Having stolen all the land, these people are now going after the only thing Indians have left, their children, aided and abetted by a hostile Supreme Court majority.

I was never a huge fan of Barack Obama, finding him politically amateurish and naive and far too willing to cave-in. I was never a fan of the Affordable Care Act, which struck me as a kludge that basically amounted to a bribe to the private insurance industry that has been feasting on human misery for decades. I have to say, though, I’m REALLY enjoying all the Right Wing wailing, rending of garments of gnashing of teeth.

Republican Healthcare Plan Upheld By Supreme Court

In a stunning victory for Mitt Romney, a narrowly and bitterly divided US Supreme Court today upheld his controversial signature legislation, the Patient Protection and Affordable Care Act.

Here’s another question for you: given that Attorney General Greg Abbott is such a staunch proponent of tort reform and so opposed to frivolous lawsuits, will he now reimburse the tax payers of Texas for all the money he wasted opposing the Affordable Care Act?  And suing the EPA?  And supporting the Arizona immigration law?  I’ll get right to holding my breath waiting for that to happen.

Mother Jones tracks down the dark history of dark money, beginning with (surprise, surprise) Nixon.  Though there has been some nonsense lately in the MSM about how the Chief Justice was “shocked, shocked” by the results of Citizens United, that’s just so much eyewash.  Citizens United was Roberts’ baby and it has achieved precisely the desired result:  a plutocracy.  Needless to say, I have almost no faith that the Supremes will do anything to disturb this in the pending Montana case American Tradition Partnership v. Bullock.

UPDATE:  Mitch McConnell is also a hypocritical tool.  If only the president had nominated a former college slut from “the Heartland” who drives an SUV and who is loud and proud about being straight (or gay), who is married with kids and also a man and was a judge for decades who attended a second or third tier law school, appreciates the constitutional value of slavery,  and plays baseball (but not like a lesbian or anything), then the Republicans would still vote against her.  Or him.  Whatever.

Conservative Activist Judges

George Will speaks truth: conservatives really do want “activist” judges, provided they are “activist” in the right direction.  He might also have mentioned Bush v. Gore, surely the most activist (not to mention anti-States’ Rights) decision of the Court so far this century.
